Views on quality of tax regulations on real property. Polish and Russian experiences

Problem jakości prawa to kwestia niezmiernie ważna, wpływająca na poziom pewności sytuacji prawnej adresatów norm prawnych. Wysoka jakość prawa jest pożądana, buduje zaufanie do państwa, świadczy o praworządności, dbałości o ochronę interesu obywateli. Stanowczo i wyraźnie formułowane są postulaty konieczności dbania ustawodawcy o wysoki poziom regulacji prawnych. Jednocześnie trzeba być świadomym, że osiągnięcie tego celu, we wciąż zmieniającej się rzeczywistości współczesnego świata jest trudne, w szczególności w zakresie prawa podatkowego. Wyjątkiem w tym zakresie nie są regulacje dotyczące opodatkowania nieruchomości, mimo że jest to jeden z przedmiotów, które najwcześniej podlegały opodatkowaniu.
Celem niniejszej pracy jest analiza jakości regulacji prawnych dotyczących opodatkowania nieruchomości w Polsce i Rosji.
Jakość prawa to wartość demokratycznych państw prawa. Należy zdać sobie jednak sprawę z tego, że wiele czynników wpływa na budowanie jakości prawa. Jest to problem złożony. W tym kontekście zaskakujące może okazać się to, że nie jest ona jednolicie rozumiana.
W publikacji przedstawione są poglądy przedstawicieli nauki w Rosji i Polsce na problem jakości prawa. Ponadto zostaną omówione, przy zachowaniu odpowiedniego stopnia ogólności, krajowe regulacje dotyczące opodatkowania nieruchomości, co będzie stanowić przyczynek do przeprowadzenia rozważań w zakresie konkretnych kwestii, problemów, aspektów i doświadczeń związanych z jakością przepisów podatkowych dotyczących opodatkowania nieruchomości w Polsce i Rosji.
